Dear Atty Massamore:

     In December of 1999, I forwarded a check from benefactors of Tom
Padgett in the amount
of $11,835.95 to the law firm of Mobley & Lloyd
in order to dismiss this action as specified in the
November 1998 Pre-trial Diversion Agreement
and the February of 1999 Supplemental Pre-trial Diversion Agreement.  It
is my understanding that these funds are now in the hands of the Hopkins
Circuit Court being held
until a settlement is made in this matter or the
Court of Appeal action runs its course in civil
matters still pending.
     If this is not the intent of the Commonwealth
of Kentucky to rightfully dismiss this matter after
settlement is made by October 30, 2000, kindly
return the above amount to me in the form of a
certified check made out to:  
        "John F. Padgett and/or A.B.U.S.E."
     I am certain you can see the necessity in addressing this matter.

Note: The court instead of transferring these
funds to apply to (alleged) support arrears
which would result in a dismissal, chose to have a felony rap on cult
victim Tom Padgett
as a higher priority than clearing up the over-
litigated mess.  To date, the $11, 835.95 has
not been returned, nor has it been applied to
alleged support owed.
